3. No Obligation; No Attorney-Client Relationship

Submitting a contact form, receiving a phone call, or accepting a preliminary verbal offer does not create any binding legal agreement between you and Capital Dynamics. A binding agreement exists only when both parties sign a final purchase and sale agreement.

You are free to decline any offer for any reason, at any time, with no penalty or fee. Similarly, we reserve the right to withdraw an offer before a signed agreement is in place.

  • Water damage or mold
  • Pest infestation
  • Environmental hazards (lead paint, asbestos, underground storage tanks)
  • Code violations or outstanding liens

Failure to disclose material defects may result in a reduction of the offer price or, in the case of fraud, rescission of the purchase agreement.

9. Limitation of Liability

To the fullest extent permitted by law, Capital Dynamics and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, including but not limited to:

Dispute Resolution Process:

  2. Binding Arbitration: If the dispute cannot be resolved informally within 30 days, it shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Texas.
  3. Exceptions: Either party may bring a claim in small claims court (if eligible) or seek injunctive relief in a court of competent jurisdiction to protect its intellectual property rights.

You waive the right to participate in a class action lawsuit or class-wide arbitration against Capital Dynamics.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement
